Who we are
Brighton Therapy Centre (BTC) is a registered charity that offers a range of talking therapies and counselling, with a goal of making these services affordable to all members of the community.

Your data and why we process it:
BTC processes your data, including your name, date of birth, contact details, so that we can communicate with you confidentially about our service.
We may also process information about your financial circumstances to determine whether you are eligible to access funding provided by BTC. BTC may also process data that relates to your mental and/or physical health. BTC processes this information because it is necessary for us to do so to provide you with the services you have contracted with us to provide or to respond to your enquiries prior to you deciding whether you want to go ahead with contracting with BTC for our services.
BTC recognises that the information you provide concerning your mental or physical health is particularly sensitive. BTC processes this data so that we can provide you with an appropriate confidential counselling or psychotherapeutic service but also because we are required to process and retain this data by our insurers in the event that BTC is required to defend a legal claim. We explain more about how long BTC will retain your health data below.
BTC may also process sensitive information relating to your ethnicity, gender, sexuality, religious beliefs and/or disabilities if you have explicitly agreed to share this information with us during the booking process. We process this information to help us understand the backgrounds of our service users and check that we are providing an inclusive service.
BTC will also use your contact details for marketing purposes to promote our services if you have consented to us doing so.
BTC may also use the contact details you provide us with to contact you to ask for feedback about our services. BTC has a legitimate interest in using your data for this purpose as it helps us to maintain a quality service.
Who we share your data with:
BTC may share all the information you provide with our approved therapists to fulfil our contractual agreement with you.
If BTC becomes aware of a risk of serious harm to yourself or another we may share information relevant to this with relevant authorities, such as a GP or Social Care. If you disclose information that we consider relates to money laundering or terrorism, BTC has a legal obligation to pass this information to the police.
Your data will also be processed by our IT partners, the Sussex Internet Community Support Project, Pragmatiq Solutions and Microsoft. These organisations have their own privacy policies, which are available on their websites:

Your name and contact details may also be processed by other organisations and individuals, including our bookkeeper, accounting software provider and others, who provide services on behalf of BTC in the ordinary course of our operations.
In all other circumstances, BTC will not share your data with third parties without your explicit consent.
Data retention:
BTC will retain your data for 7 years from the date of your last contact with us to comply with the requirements of our insurers.
Rights available to you:
You can contact BTC using the details provided to exercise the rights you have in respect of your data:
- You can request access to the data that we hold in relation to you.
- You can request rectification of data that you believe that is inaccurate or incomplete.
- You can request that BTC restricts the processing of your data.
- You can request that BTC erases the data it holds in relation to you (see below).
- You can request your data be provided to you in format for your own purposes across different services (data portability).
- You can object to BTC using your data for marketing purposes.
You can make a request to exercise these rights verbally or in writing. To protect against malicious requests, BTC may ask you to provide ID documentation that confirms your identity before we consider how to respond to your request.
In circumstances where BTC is required to retain your data to comply with the requirements of our insurers and to defend legal claims, the right to have your data erased does not apply. There are also other lawful exemptions within data protection legislation that may allow BTC to refuse a request to exercise the rights outlined above.
If BTC has asked for your consent to process your data, for example information about your background or whether you would like to receive marketing materials, you can withdraw this consent at any time.

BTC routinely collects and uses the following categories of personal data that relate to you:
- Information relating to your application, including your application form, CV, references, qualifications, supervisor, and membership of professional bodies;
- Your contact details and those of your emergency contacts;
- Your bank details;
- Your identification documents;
- Information relating to your performance in relation to work carried out at BTC;
- Records of training and CPD you complete;
- Information associated with your use of BTC IT systems, networks, and devices.
BTC may also occasionally process additional categories of data that relates to you from time to time in the ordinary course of our operations.
BTC processes your data to achieve our legitimate purpose of providing and maintaining a high-quality counselling and psychotherapeutic referral service.
To achieve this purpose, it is necessary for us to:
- process information relating to practitioners’ professional insurance and registration details;
- keep records of practitioners’ qualifications; monitor the performance of practitioners;
- comply with the requirements of our insurers;
- defend BTC against any legal claims made against the Charity;
- process your financial information to allow us to pay practitioners in the pursuit of our charitable aims; and
- maintain accurate information about practitioners contact details to enable BTC staff to contact you.
If you have provided BTC with information about your background and identity, such as your racial or ethnic origin, religious beliefs, health, sex and sexual orientation, BTC will use this information to monitor the diversity of the Charity and to ensure that BTC is providing equal opportunities to all members of our community. BTC recognises that this information is sensitive and, accordingly, will only process this information for the stated purpose and with your consent, which you can withdraw at any time.
BTC may also publish information that you have provided us with, such as your name, photograph, and information about your professional qualifications and experience, on our website for the purpose of informing existing and potential BTC service users.
BTC may also process information relating to DBS checks undertaken on affiliated practitioners to ensure that they are not barred from carrying out counselling or psychotherapy, which are regulated activities. If there is a dispute about the information contained on the certificate, BTC may retain a copy of the certificate for up to 6 months. Otherwise, BTC will only keep a retain a record of the certificate number, the level and type of check, and the date the certificate was issued.
Who we share your data with:
Your data will be processed by our IT partners the Sussex Internet Community Support Project, Pragmatiq Solutions and Microsoft.

We may also share your name and bank account details with our bank, Santander, and bookkeeping software provider, QuickBooks, so that we can process payments that you have asked us to make to you. We may also share your information with our insurers and insurance brokers: Aviva, Balens and Bennett Christmas. BTC may also share your details with other individuals and organisations who provide services on behalf of BTC in the ordinary course of our operations.
If BTC becomes aware of a risk of serious harm to yourself or another we may share information relevant to this with relevant authorities. If you disclose information that we consider relates to money laundering or terrorism, BTC has a legal obligation to pass this information to the police.

BTC is a ‘data controller’ for your personal data and is registered with the Information Commissioners Office.
Your data and why we process it:

- Your contact details and those of your emergency contacts;
- Your bank details, your tax code and national insurance number;
- Your identification documents;
- Information relating to your contract, role, salary, pension and holiday entitlements;
- Information relating to your performance and behaviour at work, and disciplinary or grievance matters;
- Records of training and CPD you complete;
- Information associated with your use of BTC IT systems, networks and devices;
BTC may also occasionally process additional categories of data that relate to you from time to time in the ordinary course of our operations,
BTC processes this information to enable the Charity to fulfil any contractual agreement that it may have with you or to decide whether to enter a contract with you. This includes:
- making decisions about your recruitment and employment;
- complying with various legal requirements, including immigration law, employment law, health & safety law and tax law;
- defending any legal claims made against BTC;
- complying with the requirements of our insurers;
- providing references requested in relation to you;
- fulfilling the operational needs of BTC.

BTC will also share your information with individuals and organisations that provide banking, accounting, bookkeeping, pension, and payroll services to the Charity, as well as HMRC. We may also share your information with our insurers and insurance brokers.
BTC may also share your details with other individuals and organisations who provide services to BTC in the ordinary course of our operations.
If BTC becomes aware of a risk of serious harm to yourself or another we may share information relevant to this with relevant authorities. If you disclose information that we consider relates to money laundering or terrorism, BTC has a legal obligation to pass this information to the police.

How long will we retain your data:
BTC will retain your data for 6 years following your last date of employment or engagement with the Charity.

Your booking with Brighton Therapy Centre (BTC) for an initial consultation is subject to the following terms and conditions.
Your attention is specifically drawn to paragraph 6.5.
Scope
1.1. These terms are intended to create a legally binding contractual agreement between users of our service (‘you’) and Brighton Therapy Centre (‘the Centre’).
1.2 The terms apply exclusively to the Centre’s provision of the service as defined in section 3.
1.3 The terms of this contract shall be constructed in accordance with the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English courts.
Payment terms
2.1 The price of the service will be that which is advertised and charged on our website: brightontherapycentre.org.uk
2.2 You will make payment for the service in advance at the point of booking.
2.3 The Centre will refund you the amount you paid for the service if you cancel the contract in accordance with paragraph 5.1 or if the Centre cancels the service as set out in paragraph 5.3.
2.4 You are not entitled to any refund if the contract is terminated in any of the circumstances set out in paragraph 5.2.
2.5 Subject to paragraph 2.4, if you attend the session and the Centre is unable to provide you with any appropriate referral for ongoing therapy, the Centre will refund you the amount you paid for the service.
The service
3.1 The service that the Centre will provide to you is one initial consultation session of up to 50 minutes between you and a therapist approved by the Centre. The session may take place in-person, at a location approved by the Centre, or via video or voice call technology. You will select the time and date of the session during the booking process.
3.2 The service also includes the Centre reviewing the information that you have shared during this session and deciding whether it would be appropriate to refer you to a therapist approved by the Centre. The Centre will communicate this decision to you.
3.3 The service does not include a guarantee that you will be referred to a therapist approved by the Centre. The service can be provided in full without the Centre making any referral for you or providing you with any recommendation for further services.
3.4 References to ‘session’ and ‘scheduled session’ in these terms shall be interpreted in accordance with the definition provided in this section.
Booking
4.1 You can book the service on our website or by communicating with us directly, such as by voice call, email, or in-person.
4.2 These terms apply whenever the Centre is providing the service, regardless of how it has been booked.
Cancellation
5.1 You may terminate this contract up to 48 hours in advance of the scheduled session by providing the Centre with written notice. Notice must be emailed to [email protected].
5.2 This contract will also terminate if any of the following circumstances apply:
- After you have attended the session, you do not respond to a communication from the Centre within 14 days.
- You do not attend your scheduled session and the Centre, or its approved therapist, is not at fault.
- You make yourself available to attend the session more than 20 minutes after the time that the session was scheduled to start, and it is not possible to reschedule the session.
- You notify the Centre that you do not intend to attend the session within the 48 hours prior to the session’s scheduled start time.
- You notify the Centre that you no longer wish the Centre to provide you with the service.
- The service as described in section 3 has been provided in full.
5.3 The Centre may also terminate the contract by providing you with written notice.
5.4 If the contract is terminated in any of the circumstances set out within this section the Centre will no longer have any obligation to provide you with the service.
Limitation of liability
6.1 If the service that you receive is inadequate, any re-imbursement made by the Centre to you will be no more than the full amount that you paid for the service.
6.2 Alternatively, if the service that you receive is inadequate, you may ask the Centre to perform the entire service again, at no extra cost to you.
6.3 For the purpose of this section, the Centre accepts that the service will be inadequate if:
- The session does not go ahead at the scheduled time and date and the Centre, or it’s approved therapist, is at fault and you have not been provided you with any notice.
- You are offered less than 30 minutes for the session, and this is the fault of the Centre or it’s approved therapist.
- The service is not carried out with reasonable care and skill.
- The Centre is unable to offer you the service at the time and date that you selected when you made the booking and is also unable to offer you an alternative time for the session within 30 days of this date.
YOUR ATTENTION IS SPECIFICALLY DRAWN TO THE PROVISION BELOW:
6.5 To the extent to which the law of England and Wales permits liability for breach of contract and negligence to be restricted, the liability of the Centre for all losses in relation to this contract is limited to £100.
